Terms of Service

1. Parties and Scope
These Terms of Service govern the relationship between Arken Visuals ("Arken", "we", "us", "our") and any individual or entity ("Client", "you") that engages Arken for architectural visualization, virtual staging, 3D rendering, animation, or any related digital production services. By submitting a project brief, approving a proposal, or making a payment, you agree to these terms in full.
2. Project Initiation and Scope
All projects begin with a written proposal that specifies the deliverables, timeline, revision policy, and total fee. Work does not begin until the Client has reviewed and approved the proposal in writing and the initial deposit has been received. Any scope changes requested after project initiation are discussed and priced separately before additional work begins.
3. Client Responsibilities
The Client is responsible for providing all project materials in a complete and timely manner. Project timelines begin from the date all required materials are received. The Client warrants that they have the legal right to share all materials provided to Arken.
4. Payment Terms
A deposit of 50% of the total project fee is required before work begins. The remaining 50% is due upon delivery of final files. Invoices are due within 7 days. Late payments beyond 14 days accrue a monthly service charge of 1.5%.
5. Revisions
Each project includes one round of revisions within the original agreed scope. Out-of-scope changes are quoted and billed separately before any additional work begins.
6. Delivery and File Ownership
Upon receipt of full payment, the Client owns the delivered final files for their intended use. Arken retains the right to display the work in its portfolio unless the Client requests confidentiality in writing prior to project initiation.
7. Turnaround Times and Delivery
Stated delivery dates are estimated from the date all required client materials are received. Arken is not liable for delays caused by incomplete or late client-provided information.
8. Cancellations and Refunds
If cancelled before work begins, the deposit is refunded minus a $75 fee. If cancelled after work begins, the deposit is non-refundable.
9. Limitation of Liability
Arken's total liability is limited to the amount paid for the specific project. Arken is not liable for indirect, consequential, or incidental damages.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States.
